Activist Okiya Omtatah moves to court in a bid to bar DCJ Mwilu from acting as Chief Justice

Activist Okiya Omtatah wants the court to bar the Judicial Service Commission from appointing Deputy Chief Justice Philomena Mwilu to act in the office of the Chief Justice.

This is unless they clear all the corruption allegations levelled against her.

Chief Justice David Maraga who starts his terminal leave today retires in January 2021.

“Pending the inter-parties hearing and determination of this case, the court be pleased to issue a temporary order prohibiting JSC from appointing DCJ Mwilu to act in the office of the Chief Justice unless and until the JSC clears her of the allegations of corruption and abuse of office contained in the pending four petitions seeking her removal,” reads the petition filed by the activist.

The activist further argues that there are currently four different petitions filed at the JSC seeking to remove Mwilu from office.

Omtatah says he is aggrieved that the commission which is mandated to ensure the professionalism of judges is deliberately delaying to determine Mwilu’s matters.
